애플의 터치스크린 특허(U.S Patent #7,966,578)에 대한 고찰?

우리나라 신문기자들을 전부 욕하는 건 아니지만 그들은 뭔 사실이 떳다고 하면 사실을 부풀려서 강조하기 마련이다. 특히 일반인들이 잘 모르는 IT분야에서의 논쟁이라면 더욱 그렇다. 흔히 설래발이라고 하는 이들의 기사들은 애플의 특허 때문에 삼성, LG 등의 터치스크린을 모두 바꿔야한다는 과장해석을 하고 있다.
그래서 본인은 직접 구글을 통해서 외국사이트들을 뒤지곤 한다.

먼저 미국 특허청의 원문에서 요약한 글을 퍼오면 (여담이지만 전문은 너무 길다)

A computer-implemented method, for use in conjunction with a portable multifunction device with a touch screen display, comprises displaying a portion of page content, including a frame displaying a portion of frame content and also including other content of the page, on the touch screen display. An N-finger translation gesture is detected on or near the touch screen display. In response, the page content, including the displayed portion of the frame content and the other content of the page, is translated to display a new portion of page content on the touch screen display. An M-finger translation gesture is detected on or near the touch screen display, where M is a different number than N. In response, the frame content is translated to display a new portion of frame content on the touch screen display, without translating the other content of the page.

대충 앞의 문장만 읽으면 터치스크린 작동방법을 뜻하는 것일수도 있다. 하지만 뒷 부분을 자세히 읽어보면 이러한 내용이다.

'프레임으로 나뉘어진 화면에 프레임 밖과 안에 내용이 포함되어 있을 경우, n개의 손가락으로 스크린이나 그 주변을 터치하면 본문의 내용이, m개의(m은 n이랑 다른 숫자) 손가락으로 스크린이나 그 주변을 터치하면 본문 속에 들어있는 프레임의 부분만 조작되고 본문의 내용에서 그 동작을 수행해도 본문에는 영향을 미치지 않는 것."

다시 말하면 프레임으로 나눠진 화면에 한해 손가락 개수에 따른 동작의 해석(translation)에 관한 특허라는 것이다.

 싱글 제스쳐(4210)가 바깥 프레임(4208)에서 작용하면 바깥 프레임의 스크롤이,
 더블 제스쳐(4214)가 안쪽 프레임(4216)에서 작용하면 안쪽 프레임의 스크롤이 움직인다.

결론적으로 애플이 이 특허를 가지고 과대해석해서 모든 터치스크린 OS 작동방법에 대해 고소하는 최악의 상황만일어나지 않는다면 영향받을 이유가 없다는 것이다.^[각주:1] 실제도 애플은 정전식 터치스크린을 개발하지도, 멀티터치 기술을 개발하지도 않았다. 하지만 제스처에 대한 특허는 위와 같이 획득하고 있지만 실제 안드로이드나 WP7등에 직접적인 영향을 미칠 가능성은 희박하다는 것이다.
